State v. Brandon Barlow – Guilty Plea and Sentencing

Concord, NH – Attorney General John M. Formella and Merrimack Police Chief Brian Levesque jointly announce that Brandon Barlow, age 35, of Nashua pleaded guilty today and was sentenced in Hillsborough County Superior Court (Southern District) for Dispensing a Controlled Drug (fentanyl) – Death Resulting.

Mr. Barlow was sentenced to 6-12 years in the New Hampshire State Prison, with 2 years suspended from the minimum portion of his sentence, for dispensing a controlled drug with death resulting. Mr. Barlow has the opportunity to earn an addition 6 months off the minimum portion of sentence if certain conditions are met.

On March 6, 2018, members of the Merrimack Police Department began investigating the overdose death of Matthew Bailey, 25, of Webster. The investigation determined that in the evening hours of March 5, 2018, Mr. Barlow dispensed fentanyl to Mr. Bailey which Mr. Bailey then used and overdosed on.

This successful investigation and prosecution was the result of the joint efforts of the Merrimack Police Department and the New Hampshire Department of Justice's Drug Prosecution Unit. Senior Assistant Attorney General Danielle Sakowski and Assistant Attorney General Meghan Hagaman prosecuted this case.
