Residential Care Facility Employee Pleads Guilty and is Sentenced on Simple Assault

Concord, NH – Attorney General Gordon J. MacDonald and Rye Police Chief Kevin Walsh announce that Hugh D. McIntyre, age 70, of Greenland, New Hampshire, pled guilty on August 18, 2020, to one count of Simple Assault.

Mr. McIntyre was charged with inappropriately touching an 86-year-old woman while employed as a custodial staff member at a residential care facility in Rye, New Hampshire in January of 2019. After pleading guilty, Mr. McIntyre was sentenced to twelve months at the Rockingham County House of Corrections, stand committed, with the recommendation that his sentence be served on Administrative Home Confinement. He was further ordered not to have contact with the victim, her family, and one of the witnesses. He was also ordered not to seek or accept employment working with, or at any locations serving elderly or incapacitated individuals.

Senior Assistant Attorney General Sean Gill and Attorney Stephanie Johnson prosecuted this case along with Investigator Robert Freitas.

Under New Hampshire law, the Attorney General is responsible for the prosecution of a health care facility employees charged with willful abuse, mistreatment or neglect of a patient.
