Concord, NH – Attorney General John M. Formella announces that Jordan M. Dunne, (age 28), of Warner, pleaded guilty and has been sentenced in the Sullivan County Superior Court to felony attempted theft by deception for conduct occurring in Lebanon, New Hampshire in 2020 and to felony theft by deception and misdemeanor unfair and deceptive business practices for conduct occurring Claremont in 2022.

The investigation in this case established that between January 1, 2020, and January 31, 2020, Mr. Dunne attempted to obtain funds in excess of $1,000 by falsely representing that he was a New Hampshire licensed asbestos abatement professional and that building samples he obtained from a Lebanon business were sent to a lab and tested positive for asbestos.

Thereafter, between June 22, 2022, and July 31, 2022, Mr. Dunne obtained funds in excess of $1,000 from a consumer by falsely representing that he was a New Hampshire licensed asbestos abatement professional and that building samples he obtained from a Claremont residence were sent to a lab and tested positive for asbestos.

The Court sentenced Mr. Dunne to 12 months in the house of corrections, with all but 30 days suspended for a period of three years. The Court also ordered Mr. Dunne to pay restitution to all victims in full on the day of sentencing. Mr. Dunne was ordered to complete two years of probation. He is also prohibited from engaging in asbestos abatement activities or applying to renew his asbestos abatement license during the three-year suspension term.

This case was investigated by Department of Environmental Services – Air Resources Division and Investigator Fredrick Lulka of the Consumer Protection Bureau.  The case was prosecuted by Assistant Attorney General Melissa Fales of the Environmental Protection Bureau and Assistant Attorney General Mary Stewart of the Consumer Protection and Antitrust Bureau.
