John Fleming, Jr. Pled Guilty to Voting in More than One State Prohibited

Concord, NH – Attorney General Gordon J. MacDonald announce that John Fleming, Jr. of Hampton, New Hampshire and Belchertown, Massachusetts, pled guilty to Voting in More than One State Prohibited – a Class B Felony – in Rockingham County Superior Court on Monday, December 16, 2019.

Mr. Fleming was alleged to have knowingly checked in at the checklist in Hampton and cast a New Hampshire ballot, after having cast a ballot in the same election year in Massachusetts.

Mr. Fleming was sentenced to 60 days at the House of Corrections, all suspended for one year on the condition of his good behavior. The Court also ordered Mr. Fleming pay a $1,000 with a penalty assessment of $240.

In addition, as a consequence of Mr. Fleming's election law conviction and pursuant to Part I, Article 11 of the New Hampshire Constitution, his right to vote in New Hampshire is terminated.

Assistant Attorney General Nicholas Chong Yen, of the Election Law Unit, and Associate Attorney General James Boffetti prosecuted this case along with Chief Investigator Richard Tracy.
