Douglas Carl Smith Jr. Charged for Wrongful Voting

Concord, NH – Attorney General Gordon J. MacDonald announces that Douglas Carl Smith Jr. of Warner, New Hampshire, (age 30), was arrested on March 10, 2019 on three counts of Wrongful Voting for voting in two places during the March 13, 2018 Town Election.

Mr. Smith was charged with a class B Felony for violating RSA 659:34, I (e) for knowingly voting in an election that he was not qualified to vote in when he voted in both the Towns of Grafton and Danbury during the March 13, 2018 Town Election.

He was also charged with two class A misdemeanors for knowingly applying for a ballot after already voting once during the March 13, 2018 Town Election and for knowingly providing false information on an election day voter registration form.

Mr. Smith will be arraigned in Merrimack County Superior Court on March 28, 2019 at 1:00 p.m.

The investigation into this case was conducted by Chief Investigator Richard Tracy of the Election Law Unit and is being prosecuted by Assistant Attorney General Matthew Broadhead, also of the Election Law Unit. The arrest was made by the Warner Police Department.

The charges and allegations are merely accusations, and Mr. Smith is presumed innocent unless and until proven guilty.
