Civil Enforcement Action and Motion for Preliminary Injunction Filed Against Trigram Education Partners, LLC, for Unfair and Deceptive Business Practices in the Operation of the American School of Nursing and Medical Careers

Concord, NH—Deputy Attorney General Jane E. Young announces that a civil enforcement action and motion for preliminary injunction have been filed in the Merrimack County Superior Court against Trigram Education Partners, LLC ("Trigram"). The complaint alleges that Trigram violated the New Hampshire Consumer Protection Act by engaging in unfair and deceptive acts or practices in its management and operation of the American School of Nursing and Medical Careers in Manchester, New Hampshire.

Trigram is headquartered in New Haven, Connecticut. The complaint further alleges that, between August and December 2020, Trigram repeatedly deceived students about the school's loss of accreditation, loss of higher education bond, and eviction from its campus for failure to pay rent. Additionally, the State alleges that Trigram deceptively told students that they would be refunded if they chose to withdraw from the program. However, Trigram issued a bill for payment to at least one student rather than the promised refund.

Trigram admitted to another student that the company has no financial ability to pay refunds. The State filed a motion for preliminary injunction in an effort to immediately stop Trigram from collecting student payments.

The New Hampshire Board of Nursing ordered an emergency suspension of the school's license on October 16, 2020. The New Hampshire Higher Education Commission ordered an emergency suspension of the school's license on December 15, 2020.

The State is seeking restitution for students, injunctive relief, civil penalties, and attorney's fees in this civil action.

Assistant Attorney General John W. Garrigan of the Consumer Protection and Antitrust Bureau is prosecuting this case.
