Attorney General Issues Reminder for Developers to Register Condominiums and Subdivisions Prior to Sales

Attorney General Peter W. Heed issued a reminder today that prior to the sale of lots or units in condominium or subdivision developments, most developments must be registered with the Consumer Protection and Antitrust Bureau of the Attorney General’s Office. “The number of lots or units dictates whether registration is required,” Heed said.
According to Heed, there has been an increase in the number of developers, title companies, and real estate agents who are unaware of this requirement and, consequently, have not registered with the Bureau prior to selling lots or units. Registration is required by the Land Sales Full Disclosure Act, NH RSA 356-A and the Condominium Act, NH RSA 356-B. “Sales prior to registration are against the law,” Heed said, “and this Office can petition the Court for an injunction or a fine or other relief as well.”
