Belknap County Jury Convicts Edward Shaughnessy and Black Oaks Laconia, LLC, of unpermitted wetlands fill and terrain alteration in Laconia

Attorney General Kelly A. Ayotte and Belknap County Attorney James Carroll announced today that Edward Shaughnessy of Gilford and Black Oaks Laconia, LLC, were convicted of the following charges after a four day jury trial in Belknap County Superior Court:
Edward Shaughnessy Unpermitted Fill in Wetlands, Misdemeanor
Unpermitted Terrain Alteration, Misdemeanor
Black Oaks Laconia, LLC Unpermitted Fill in Wetlands, Felony
Unpermitted Terrain Alteration, Misdemeanor
Edward Shaughnessy altered terrain in excess of 100,000 square feet on property owned by Black Oaks Laconia, LLC, a trust of which he is a beneficiary, without obtaining a terrain alteration permit from the Department of Environmental Services. In addition, Edward Shaughnessy, on behalf of Black Oaks Laconia, LLC, dredged and filled wetlands without a permit on property owned by White Oaks Realty Trust, LLC, to construct an accessway between the Black Oaks Laconia, LLC property and White Oaks Road in Laconia. The jury acquitted Edward Shaughnessy of one count of timber trespass for removing the trees from the White Oaks Realty Trust, LLC property prior to building the accessway. The Honorable Bruce Mohl presided over the trial and will hold a sentencing hearing during the week of July 2, 2007.
Attorney General Kelly Ayotte stated, “The environmental laws were passed to protect New Hampshire’s vital natural resources. The jury’s verdicts in this case validate that those laws must be taken seriously by all of New Hampshire’s citizens.” Attorney General Ayotte expressed her appreciation to the State and local agencies that worked very hard on this case to bring it to a successful conclusion, including, the Department of Environmental Services, the Department of Resources and Economic Development, Division of Forest and Lands, the Belknap County Sheriff’s Department, the Laconia Police Department, and the Belknap Accident Reconstruction Team.
