The New Hampshire Department of Health and Human Services, through its Commissioner, Nicholas A. Toumpas, and New Hampshire Attorney General Michael A. Delaney, entered into an agreement with the United States Department of Health and Human Services, Centers for Medicare and Medicaid Services (CMS), whereby CMS will recover from the State $35,325,468 of Medicaid disproportionate share hospital funds disallowed by CMS for federal fiscal year 2004. The CMS disallowance was upheld by the federal Departmental Appeals Board in a decision issued by the Board on October 14, 2011. CMS will recover the funds through quarterly installments over a two-year period commencing in January 2012.
