Charitable Trusts Unit
Attorney General Michael A. Delaney issues the following consumer alert to citizens in the State of New Hampshire:
Charitable organizations formed in the State of New Hampshire, and out-of-state charitable organizations soliciting donations from citizens of the State of New Hampshire, are required to register with and report to the Attorney General. The Dalquest Group of Manchester, a nonprofit, charitable organization, has not completed its registration with the Attorney General's Charitable Trusts Unit despite repeated requests to file the required documentation. As a result, the Dalquest Group is in violation of New Hampshire law, including, but not limited to, RSA 7:28, I (registration requirements), RSA 7:28, II (reporting requirement), RSA 7:28, VI (breach of trust), and RSA 7:28-f (penalties).
The Dalquest Group ("the organization") was formed in 2009 for the purpose of "… provid[ing] recreational opportunities for children, handicapped, terminally ill or otherwise challenged or needy, … and to raise and provide the financial support for such activities … The organization is organized exclusively for charitable, religious, educational and scientific purposes under IRC Section 501(c)(3)." The organization is subject to the jurisdiction of the Charitable Trusts Unit pursuant to RSA 7:21, II(b)(2) ("…established, in whole or in part, for any benevolent, philanthropic, patriotic, educational, humane, scientific, public health, environmental conservation, civic, or other charitable purpose or any person who in any manner employs a charitable appeal as the basis of any solicitation or an appeal that suggests that there is a charitable purpose to any solicitation …").
After several requests to the organization the Charitable Trusts Unit received an incomplete application for registration on July 21, 2010. The Charitable Trusts Unit requested additional information by letters dated August 27, 2010, October 28, 2010, February 9, 2011, April 27, 2011, and July 10, 2011. Several of these letters were copied to board members of record, some of which have contacted the Charitable Trusts Unit stating they are no longer on the board. The most recent letter addressed to the organization was returned by the post office. To date, the organization has not provided the additional information requested.
According to the Secretary of State's Office, the Dalquest Group is registered as a nonprofit corporation and has filed its 2010 annual report. The Dalquest Group may also be operating under the name "FUNatics."
Attorney General Delaney asks potential donors to exercise extreme caution before donating to the Dalquest Group or related entities and, if any citizen receives a request for donations from this organization, please notify the Charitable Trusts Unit at (603) 271-3591 immediately.
