Charitable Trusts Unit
Attorney General Michael A. Delaney issues the following consumer alert to citizens in the State of New Hampshire:
Nonprofit organizations soliciting donations in the State of New Hampshire are required to register with and report to the Attorney General. Cairn Rescue League of Kingston, a nonprofit, charitable organization, has not registered with the Attorney General's Charitable Trusts Unit despite repeated requests to file the required documentation. As a result, Cairn Rescue League of Kingston is in violation of New Hampshire law, including, but not limited to, RSA 7:28, I (registration requirements), RSA 7:28, II (reporting requirement), RSA 7:28, VI (breach of trust), and RSA 7:28-f (penalties).
Cairn Rescue League ("the organization") was formed in 2000, "[t]o facilitate the pick up, transport, medical care, rehabilitation, fostering, and adoption of homeless or soon-to-be homeless Cairn Terries and Cairn Terrier mixes and to educate the public about responsible Cairn Terrier care and ownership." The organization is subject to the jurisdiction of the Charitable Trusts Unit pursuant to RSA 7:21, II(b)(2) ("...established, in whole or in part, for any benevolent, philanthropic, patriotic, educational, humane, scientific, public health, environmental conservation, civic, or other charitable purpose or any person who in any manner employs a charitable appeal as the basis of any solicitation or an appeal that suggests that there is a charitable purpose to any solicitation...").
On March 9, 2010, the Charitable Trusts Unit requested the organization to file an application for registration. The Charitable Trusts Unit sent another request on May 13, 2010, via certified mail addressed to all board members. Thereafter, on June 10, 2010, the head of the organization called the Charitable Trusts Unit regarding the registration requirements. Despite the telephone communication, and follow up letters sent by the Charitable Trusts Unit, no further response was received from the organization.
On February 15, 2011, the New Hampshire Secretary of State administratively dissolved the entity's corporate charter for failure to file a required report.
The entity's website <http://www.cairnrescueleague.com/> appears to be current, and donations are requested on that website.
Attorney General Delaney asks potential donors to exercise extreme caution before donating to the Cairn Rescue League and, if any citizen receives a request for donations from this organization, please notify the Charitable Trusts Unit at (603) 271-3591 immediately.
